Wrongful Death
Wrongful death claims arise when a person has died due to another's negligence. Unlike other personal injury claims, a wrongful death action may be brought by the family members specified in the California Code of Civil Procedure. The Code of Civil Procedure limits those who may file a wrongful death action to a deceased's spouse, children, or issue. If the deceased had no spouse or issue, those entitled to property in the deceased's estate may file a claim.
Traumatic Brain Injury and Spinal Cord Injuries
A traumatic brain injury ("TBI") occurs when a sudden physical force to the head causes brain damage. TBIs may be mild and temporary. They may also be permanently debilitating and even fatal. Spinal cord injury ("SCI") is damage to the spinal cord caused by a blunt force or impact to the spine. Spinal cord injuries can cause paraplegia or tetriplegia. Sufferers of SCI experience loss of feeling, loss of movement, and loss of control over certain bodily functions.

The California Welfare and Institutions Code defines elder abuse as the "physical abuse, neglect, financial abuse, abandonment, isolation, abduction" that leads to physical or emotional harm or suffering or the "deprivation by a care custodian of goods or services that are necessary to avoid physical harm or mental suffering." The Code defines an elder as anyone who is age 65 or older.
Unfortunately, elder and nursing home abuse is a widespread problem in the United States and California. Some groups estimate that as many as one to two million elders have been abused in the United States. When it can be shown that an abuser acted recklessly, fraudulently, or maliciously, California allows recovery of punitive damages in addition to compensatory damages.
